Terms of Service

Welcome to Phil in Your Pocket, an AI coaching assistant provided by Phil Le Gros T/A RePhil (“RePhil”, “we”, “us”, or “our”).

By accessing or using Phil in Your Pocket, you agree to these Terms of Service (“Terms”).
If you do not agree, please do not use the service.

1. What this service is

Phil in Your Pocket is an AI-powered coaching assistant trained on Phil Le Gros’s ADHD coaching approach.
It offers general coaching-style prompts and guidance to help you manage overwhelm, focus, and daily systems.
It is not therapy, counselling, medical, legal, or financial advice.

2. Eligibility

You must be at least 18 years old to use this service. By using it, you confirm that you are legally capable of entering into these Terms.

3. Confidentiality and privacy

Your conversations are private within the limits of the law and our Privacy Policy.
We will never sell or publicly share your chat content.
However, we may review anonymised or aggregated data to improve the service and ensure safety.

4. Appropriate use

You agree not to:

  • Use the service for any unlawful, harmful, or abusive purpose.

  • Attempt to exploit, probe, or interfere with the system.

  • Share content that promotes hate, discrimination, or harassment.

  • Seek crisis, emergency, or diagnostic advice from the AI (see section 6).

We may suspend or terminate access if these rules are breached.

5. Intellectual property

All content, prompts, training materials, and branding are owned by RePhil.
You may not copy, modify, or redistribute them without written permission.

6. Safeguarding and crisis situations

If you mention immediate risk, self-harm, abuse, or a crime, the AI may pause and display UK emergency contacts:

  • Call 999 in an emergency

  • Visit A & E

  • Call Samaritans 116 123

  • Contact NHS 111 or your GP

We may take reasonable steps to protect life or comply with legal obligations.

7. Limitation of liability

The service is provided “as is” and “as available”.
We make no guarantees of accuracy or outcomes.
To the maximum extent permitted by law, RePhil is not liable for any loss, damage, or harm arising from your use of the service.

8. Communication and updates

By using Phil in Your Pocket, you agree that RePhil may send you occasional emails or messages about:

  • Service updates or improvements

  • Related coaching or training opportunities

You can unsubscribe at any time via the link in our emails or by contacting privacy@rephil.uk.

9. Termination

You may stop using the service at any time.
We may suspend or close accounts for misuse, security, or legal reasons.
Your data will be handled as set out in the Privacy Policy.

10. Governing law

These Terms are governed by the laws of England and Wales.
Disputes will be subject to the exclusive jurisdiction of the English courts.

This Privacy Policy explains how Phil Le Gros T/A RePhil (“we”, “us”) collects, uses, and protects your personal data when you use Phil in Your Pocket.

  • Messages and interactions within the chat

  • Basic contact details if you sign up or subscribe (name, email)

  • Technical data such as device type, browser, and usage logs (for security and analytics)

We do not knowingly collect special category data unless you choose to share it in a chat (for example, references to mental health). You should avoid sharing sensitive information not relevant to coaching.

3. How we use your data

We use your data to:

  • Deliver, maintain, and improve the Phil in Your Pocket service

  • Personalise your experience and remember your past chats

  • Respond to your messages and feedback

  • Send updates or information about RePhil services (you can unsubscribe anytime)

  • Ensure safety, prevent misuse, and comply with legal obligations

4. Legal bases for processing

We rely on:

  • Legitimate interests – to provide and improve the service

  • Consent – for marketing and optional communications

  • Legal obligation – where required to comply with law or protect life

5. Sharing your data

We may share data only with trusted sub-processors who help us run the service, such as:

  • Coachvox – platform provider

  • OpenAI or other LLM vendor – language model processor

  • Bigin – CRM and communications

  • Google Analytics – anonymised usage statistics

All sub-processors operate under data-processing agreements consistent with UK GDPR.

6. Data location and retention

Data is stored securely by Coachvox and its sub-processors in regions compliant with UK GDPR.
We retain chat data for up to six months after last activity, after which it is deleted or anonymised.
You may request deletion at any time.

7. Your rights

You have the right to:

  • Access a copy of your data

  • Correct inaccuracies

  • Request deletion (“right to be forgotten”)

  • Restrict or object to processing

  • Withdraw consent for marketing

We aim to respond within 30 days.

8. Security

We use encryption, access control, and monitoring to protect your data.
Only authorised personnel can access limited information for support and safety reasons.

9. Children

The service is not designed for users under 18.
If we learn that we have collected data from a minor, we will delete it promptly.

10. Changes

We may update this policy from time to time.
The most current version will always be posted on our website, with a new “last updated” date.
